TERMS OF SERVICE FOR SYNCPHOTO Last Updated: August 22, 2026 1. ACCEPTANCE OF TERMS By downloading, installing, or using SyncPhoto (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. 2. DESCRIPTION OF SERVICE SyncPhoto is a mobile application that allows users to upload photos from their camera folder to their Google Photos account. The App provides: - Listing of camera photos in a grid - Sign-in with Google - One-by-one upload of camera photos to Google Photos - Real-time upload progress tracking - Background upload with a live progress notification - Optional video backup and sharing of videos to the user's own YouTube channel - Optional subscription for the sync feature 3. ELIGIBILITY 3.1 Age Requirements - You must be at least 13 years old to use this App - Users under 18 must have parental consent - Users under 13 are prohibited from using the App 3.2 Account Requirements - You must have a valid Google account - You must have Google Photos enabled on your account - You are responsible for maintaining the security of your account 4. LICENSE AND USAGE RIGHTS 4.1 License Grant We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes. 4.2 Restrictions You may NOT: - Reverse engineer, decompile, or disassemble the App - Modify, adapt, or create derivative works - Use the App for commercial purposes without permission - Attempt to circumvent security measures - Use the App to violate any laws or regulations - Share your account credentials with others 5. USER RESPONSIBILITIES 5.1 Content Responsibility - You are solely responsible for the photos you upload - You must own or have rights to all uploaded content - You must not upload illegal, harmful, or inappropriate content - You must comply with Google Photos Terms of Service 5.2 Device and Network - You are responsible for your device's security - You must maintain adequate storage space - An internet connection is required for uploads - Data usage charges may apply depending on your plan 6. SUBSCRIPTION 6.1 SyncPhoto Plus - The sync feature is available through a subscription called SyncPhoto Plus at $1.99 per month. - Browsing your camera photos is free. 6.2 Billing and Renewal - Subscriptions are billed and processed by Google Play Billing. - The subscription auto-renews monthly until cancelled. - You can cancel the subscription at any time from your Google Play account settings. - Cancellation takes effect at the end of the current billing period. 6.3 No Refunds - All payments are handled by Google Play. Refund requests must be directed to Google Play support. - We do not offer refunds for subscription fees unless required by applicable law. 7. PRIVACY AND DATA PROTECTION 7.1 Data Handling - We do not store your photos or videos on our servers - Photos are uploaded directly to your Google Photos account - Videos are uploaded directly to your own YouTube channel only when you enable "Share video to YouTube" - You are solely responsible for the privacy setting (private, unlisted, or public) you choose for shared videos - Local statistics are stored on your device only - See our Privacy Policy for complete details 7.2 Third-Party Services - Google Photos integration is subject to Google's Terms - Google's Privacy Policy applies to your Google Photos data - YouTube integration (when enabled) is subject to YouTube Terms of Service - Google Play Billing is subject to Google's Terms - We are not responsible for Google's service availability 8. INTELLECTUAL PROPERTY 8.1 App Ownership - SyncPhoto and all related materials are our property - All trademarks, logos, and brand names are our property - You do not acquire any ownership rights in the App 8.2 User Content - You retain ownership of your photos - You grant us no rights to your photos - We act only as a conduit to your Google Photos account 9. DISCLAIMERS AND WARRANTIES 9.1 Service Availability THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE: - Continuous or uninterrupted service - Error-free operation - Compatibility with all devices - Successful upload of all photos 9.2 Third-Party Dependencies - Service depends on Google Photos API availability - We are not responsible for Google service outages - Network connectivity issues may affect functionality 10. LIMITATION OF LIABILITY TO THE MAXIMUM EXTENT PERMITTED BY LAW: - We are not liable for any indirect, incidental, or consequential damages - Our total liability shall not exceed the total amounts paid by you for the subscription within the 12 months preceding the claim - We are not liable for data loss, though we recommend regular backups - We are not responsible for Google Photos service issues 11. INDEMNIFICATION You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from: - Your use of the App - Your violation of these Terms - Your violation of any third-party rights - Content you upload through the App 12. TERMINATION 12.1 Termination by You - You may stop using the App at any time - Uninstall the App to terminate your use - Revoke Google Photos access through your Google Account - Cancel your subscription through Google Play 12.2 Termination by Us We may terminate your access if you: - Violate these Terms - Use the App for illegal purposes - Abuse or misuse the service 12.3 Effect of Termination - Your license to use the App ends immediately - Local data may be deleted - Your Google Photos data remains unaffected 13. UPDATES AND MODIFICATIONS 13.1 App Updates - We may update the App to improve functionality - Updates may be required for continued use - New features may be added or removed 13.2 Terms Updates - We may modify these Terms at any time - Material changes will be notified through the App - Continued use constitutes acceptance of new Terms 14. GOVERNING LAW AND DISPUTES 14.1 Governing Law These Terms are governed by the laws of the Republic of Indonesia, without regard to conflict of law principles. 14.2 Dispute Resolution - Disputes should first be resolved through direct communication - If unresolved, disputes will be subject to the exclusive jurisdiction of the courts of Indonesia 15. OPEN SOURCE COMPONENTS 17.1 Third-Party Libraries - The App may include open source components - Each component is subject to its own license terms - Attribution information is available in the App 18. SEVERABILITY If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. 19. ENTIRE AGREEMENT These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App. 20. FORCE MAJEURE We are not liable for any failure to perform due to circumstances beyond our reasonable control, including but not limited to: - Natural disasters - Government actions - Internet service disruptions - Third-party service outages (including Google services) 21. FEEDBACK AND SUGGESTIONS Any feedback or suggestions you provide about the App may be used by us without any obligation to compensate you. 22. NO WAIVER Our failure to enforce any provision of these Terms does not constitute a waiver of that provision. 23. ASSIGNMENT You may not assign your rights under these Terms.
